These Terms and Conditions (“Terms”) govern your access to and use of the e-Reader.ca website and the purchase of products from us. By accessing or using our Site, or by placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site or place an order.
1. Use of the Site
You agree to use the Site only for lawful purposes. You must not:
- Violate any applicable federal, provincial, or local law or regulation;
- Interfere with or disrupt the operation or security of the Site;
- Transmit spam, viruses, malicious code, or other harmful material;
- Copy, scrape, reproduce, or resell our content without prior written permission;
- Use automated systems to create fraudulent accounts, test payment cards, submit unauthorized transactions, or interfere with checkout;
- Attempt to bypass any security, fraud-prevention, or verification system.
We may restrict or terminate access to the Site when we reasonably believe these Terms have been violated.
2. Eligibility
To place an order, you must be at least the age of majority in your province or territory of residence and have the legal capacity to enter into a binding agreement.
3. Product Information
We make reasonable efforts to ensure that product descriptions, specifications, images, availability, and pricing are accurate. However, errors may occasionally occur.
We reserve the right to correct errors, update product information or pricing, and discontinue products before an order is accepted. All prices are displayed in Canadian dollars unless otherwise stated.
Product photographs are provided for illustration. Minor differences in packaging, accessory appearance, colour representation, or manufacturer labelling may occur.
4. Orders and Payment
All orders are subject to acceptance, payment authorization, product availability, and fraud review.
An automated order confirmation acknowledges that we received your order but does not necessarily mean that the order has been accepted.
We may cancel or refuse an order, in whole or in part, where:
- The product is unavailable;
- There is an error in the product description or price;
- Payment cannot be authorized;
- Billing or customer information cannot be verified;
- The order appears fraudulent, unauthorized, or inconsistent with these Terms;
- The order cannot be shipped according to our delivery policies;
- We reasonably believe the transaction may expose us or another person to fraud, loss, or unlawful activity.
Credit card orders ship only to the verified billing address. Orders requiring delivery to another Canadian address must be paid using an approved alternative payment method, such as Interac e-Transfer.
By placing an order, you acknowledge that you have reviewed and accepted the applicable product description, product condition, included accessories, warranty information, return requirements, and refund terms.
5. Shipping and Delivery
Delivery dates and transit times displayed on the Site are estimates and are not guaranteed. Delivery may be affected by carrier delays, weather, service interruptions, address issues, missed pickup deadlines, or circumstances outside our reasonable control.
Customers are responsible for providing a complete and accurate delivery address and for promptly collecting shipments held by a carrier for pickup.
If a shipment is returned because it was refused, unclaimed, not collected within the carrier’s hold period, or addressed incorrectly by the customer, the customer may be responsible for the resulting return and reshipping costs.
Delayed or Lost Shipments
If tracking appears delayed, stalled, or does not show confirmed delivery, we may open an investigation with the shipping carrier.
While a shipment remains under active investigation, we may need to wait for the carrier’s official determination.
If the carrier confirms that the shipment was lost or not delivered, the customer will be offered either:
- A replacement shipment, subject to product availability; or
- A full refund for the affected order.
6. Product Condition Definitions
New Products
New: A new product supplied in its original manufacturer packaging. Unless otherwise stated, New products have not previously been opened by a customer.
Open Box Products
Open Box: A product in like-new cosmetic and working condition. Its original packaging has been opened, and the product may have been briefly handled.
Every Open Box device is inspected and tested before sale to confirm that it is fully functional and meets our quality standards.
Open Box products include the accessories and components identified on the individual product page. Some Open Box offers may also include complimentary cases, stylus pens, replacement nibs, or other promotional accessories.
Any important cosmetic or condition difference will be disclosed on the applicable product page.
Like-New Cosmetic & Working Condition • Fully Inspected & Tested • 1-Year Canadian Warranty • 30-Day Return Policy
Open Box Warranty and Returns
Open Box BOOX tablets include the same 1-year Canadian warranty and the same 30-day return policy as new BOOX tablets.
7. Returns and Refunds
Return Window
New and Open Box products may be returned within 30 days from delivery, subject to the conditions below and any applicable consumer rights.
Defective, Damaged, or Incorrect Products
For an approved return involving a manufacturing defect, transit damage, or an incorrect product shipped by us, we will provide prepaid return shipping where reasonably possible.
We may request photographs, video, serial-number information, troubleshooting results, logs, or other reasonable information before approving the return.
Customer-Preference Returns
If the product received matches the order and the return is based on preference, compatibility, change of mind, or no longer wanting the product, the customer is responsible for return shipping costs.
Return Conditions
Returned products must be:
- Returned within the applicable return period;
- In the same cosmetic and working condition in which they were received;
- Fully functional;
- Free from damage, scratches, excessive wear, liquid exposure, or alteration;
- Returned with all original packaging, accessories, manuals, inserts, documentation, and included components;
- Returned with all bundled or complimentary promotional items;
- Protected with suitable outer shipping packaging.
Opening the product packaging does not by itself disqualify a product from return. However, the product and all included materials must be returned in the condition required by these Terms.
Inspection
All returned products are inspected and tested after receipt.
Return authorization allows the customer to send the product for inspection. It does not guarantee that the return will qualify for a full refund.
The refund amount will be determined after the returned product and all included items have been received and inspected, subject to these Terms and applicable law.
Restocking Fee
A restocking fee of up to 10% may apply when the device remains fully functional and in like-new condition but original packaging, manuals, inserts, documentation, or included accessories are missing or damaged.
No restocking fee will be charged solely because the original packaging was opened where opening was reasonably necessary to inspect or evaluate the product.
Damage or Loss in Value
If a returned product, accessory, package, manual, insert, or promotional item is missing, damaged, altered, or returned in a condition different from how it was supplied, the refund may be reasonably reduced to reflect the resulting loss in value or replacement cost.
Products showing material damage, excessive wear, liquid exposure, altered serial numbers, unauthorized repair, tampering, or missing essential components may not qualify for a full refund.
Missing Accessories or Promotional Items
If an included accessory, bundled item, or complimentary promotional item is not returned, its reasonable current replacement cost may be deducted from the refund.
Return Verification
Customers should contact us before returning a product. We may provide return instructions and request photographs or video to help confirm the product condition and reason for return.
Refund Processing
Approved refunds are normally processed within 5–10 business days after the returned product has been received and inspected.
A refund cannot normally be completed before the original product and all required included items have been returned, except where applicable law provides otherwise.
Original shipping charges are non-refundable for customer-preference returns.
Original shipping charges will be refunded when required because of an approved manufacturing defect, transit damage, an incorrect product shipped by us, or applicable law.
8. Warranty
New and Open Box BOOX devices: 1-year Canadian warranty against manufacturing defects.
BOOX accessories: 3-month warranty against manufacturing defects.
New and Open Box BOOX devices receive the same applicable warranty coverage.
The warranty does not cover:
- Accidental or physical damage;
- Misuse, abuse, or negligence;
- Liquid or moisture exposure;
- Damage caused by drops, crushing, bending, or excessive pressure;
- Unauthorized repair, modification, or disassembly;
- Normal wear and tear;
- Consumable parts worn through normal use;
- Damage caused by incompatible accessories, chargers, or external devices;
- Environmental or natural-disaster damage.
To request warranty service, customers must contact us and provide proof of purchase, the product serial number, a description of the issue, and any reasonably requested photographs, videos, logs, or troubleshooting information.
We may require the product to be returned for inspection. For an approved warranty claim, the available remedy may include repair, replacement, or refund, depending on the circumstances, product availability, applicable warranty terms, and applicable law.
This warranty is provided in addition to any rights or remedies available under applicable Canadian consumer protection legislation.
9. Promotions, Bundles, and Complimentary Items
Promotional offers, discounts, accessory bundles, and complimentary items may be subject to product availability, eligibility requirements, quantity limits, and stated promotion periods.
Unless otherwise stated, promotions cannot be combined with other coupon codes, special pricing, institutional pricing, or previously discounted bundles.
If a product purchased with a promotional, bundled, or complimentary item is returned, all included items must also be returned.
If a bundled or complimentary item is not returned, its reasonable replacement cost may be deducted from the refund.
10. Limitation of Liability
To the maximum extent permitted by law, e-Reader.ca and Classy Flowers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Site or the purchase or use of a product.
Where permitted by law, our total liability relating to a product will not exceed the amount paid for that specific product.
Nothing in these Terms excludes or limits any liability, right, warranty, condition, or remedy that cannot legally be excluded or limited under applicable law.
11. Privacy
Your privacy is important to us. Please review our Privacy Policy.
12. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario.
Nothing in this section limits any mandatory consumer right concerning jurisdiction or dispute resolution that applies under the law of the customer’s province or territory.
13. Changes to These Terms
We may update these Terms periodically. The revised version will be posted on the Site with an updated effective date.
Changes apply to orders placed after the revised Terms are published. The Terms in effect when an order was placed will continue to govern that order unless otherwise required by law.
